Contract for Publication

PLEASE READ THE TERMS AND CONDITIONS DESCRIBED BELOW, AND THEN USE THE FORM AT THE BOTTOM TO INDICATE YOUR CONSENT.

This contract is between Kitchen Table Quarterly, hereafter referred to as the Publisher, and the author/artist whose name is indicated below, hereafter referred to as the Author. The Author grants permission to include his/her/their work, the title(s) of which is(are) entered below, hereafter referred to as the Work, in Kitchen Table Quarterly. 

1. Rights:

   1. The use of the Work by the Publisher entails the assignment of first serial rights, non-exclusive archival rights, and non-exclusive reprint rights.

   2. In the case of written works, publishing rights revert back to the Author upon publication.

   3. In the case of visual artwork, the original artist retains all rights.

   4. If the Work is not published in Kitchen Table Quarterly within eighteen months of the date of signing, all rights revert to the Author.

   5. It is understood and agreed that the Publisher may use the Work in the above-mentioned magazine, as well as in a digital archive (in perpetuity), and that the Work may appear in “best of” editions, online or in print, within two years of the original date of publication.
      

2. Compensation:

   1. It is understood by the Author that the Work will be included in Kitchen Table Quarterly online magazine without monetary compensation.

   2. Should any of the Work be included in future print editions, the Author shall receive one contributor copy.
      

3. Author Warranties and Indemnities:

   1. The Author warrants that he/she/they is the sole creator of the Work, that the Work is original and unpublished, no one has reserved the rights granted in this agreement, and the Work does not contain any material that is libelous, invades personal privacy or deprives another of the right of publicity, or is otherwise actionably tortious or illegal.
      

4. No Competing Publication:

   1. The Author agrees not to permit others to publish the Work in any form prior to its publication in Kitchen Table Quarterly and for the first 180 days after its appearance.

   2. The Author may include images/ excerpts from the Work on personal websites/blogs or in social media posts at the time of publication.

   3. Any portion of the Work already public and disclosed to the Publisher as such at the time of signing are exceptions to this clause.
      

5. Changes in Text or Title:

   1. The Publisher will make no major alterations of the Work's text or title without the Author's approval. The Publisher reserves the right to make copy-editing changes.

   2. The Publisher agrees to provide the Author with previews/digital copies of the Work for proofreading prior to publication.
      

6. Social Media Use:

   1. The Author agrees to allow The Publisher to utilize the Work in social media posts, newsletters, and other marketing materials as promotion in the lead up to and during the release of the issue in which the Work is included.

   2. The Publisher agrees to credit the Author in all social media posts/ marketing uses including the Work.

   3. The Publisher agrees not to use the Work in further social media or marketing materials, etc., after it has been moved to the archive without express permission of the Author.
      

7. The parties acknowledge that each party has read and understood the terms of this contract.
